Overview
This website is operated by Vascend. The terms “we”, “us”, and “our” refer to Vascend.
Vascend is a multi-brand digital ecosystem operating across e-commerce, publishing, music and audio, creative production, brand and partnerships management, and lifestyle and consumer markets. The Vascend ecosystem includes brands, divisions and projects such as Equanimity Essence, Vascend Pets, Practical Notes, Grounded Bodyworks, Vascend Brand & Partnerships Management, and Vascend Music.
Vascend Music is the independent music and audio division of Vascend, developing and releasing original music, distinct artist projects and purpose-built audio content, and supporting related licensing, sync, creative collaboration and commercial activities. Individual brands may maintain their own supplementary policies applicable to their specific stores or services.
These Terms of Use apply to your access to and use of vascend.com.au and Vascend-operated websites, content and services that link to or expressly incorporate these Terms (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you should not use the Services.
1. Use of the Services
You agree to use the Services for lawful purposes only. You must not:
• Use the Services in a way that violates any laws or regulations
• Attempt to gain unauthorised access to systems or data
• Interfere with the operation or security of the Services
• Use the Services for fraudulent or harmful activity
We reserve the right to restrict or terminate access for misuse.
2. Information and Content
Content provided across the Services is for general informational and educational purposes. While we aim to provide accurate and up-to-date information, we do not guarantee completeness, accuracy, or reliability. You are responsible for assessing whether information, products, or recommendations are suitable for your personal circumstances.
3. Affiliate and Commercial Content
Some content may include affiliate links or commercial relationships. We may receive commissions or other benefits if you interact with or purchase through those links. These relationships do not change our approach to content, which remains focused on practical value, clarity, and usability. Where content is directed at audiences in the United States, affiliate relationships are disclosed in accordance with the FTC Endorsement Guides.

Certain Vascend brands may offer products or services. All purchases are subject to the applicable brand-specific policies, including pricing, shipping, and returns and refunds. Product descriptions and availability may change without notice.
5. Third-Party Platforms
The Services may include links to third-party websites, platforms, or tools. We are not responsible for third-party content, privacy practices, or transactions conducted outside our platforms. Use of third-party services is at your own risk.
6. Intellectual Property
Content, materials and branding within the Services, including text, images, graphics, branding, content structure, sound recordings, musical works, audiovisual works, artwork and other creative materials, are owned by, controlled by, or licensed to Vascend, except where stated otherwise. Different elements of a release or piece of content may carry different rights, particularly across Vascend Music's catalogue as it develops.
You may not reproduce, distribute, sell, licence or otherwise commercially exploit any content without prior written permission, except for personal, non-commercial browsing and viewing of the Services as they are ordinarily presented to you. This personal-use allowance does not extend to music, sound recordings or audiovisual works, which are addressed separately in clause 7.
Where content is produced with the assistance of artificial intelligence tools, Vascend's rights are limited to whatever ownership, control or licence actually exists in that content under applicable law. Nothing in this clause represents that Vascend holds copyright broader than the law provides.
7. Music and Audio Content
Where Vascend Music or any Vascend brand makes music, sound recordings, or audiovisual material available through the Services, you may listen to or view that content as made available to you. You must not copy, reproduce, distribute, republish, modify, commercially exploit, synchronize, sample, remix, or otherwise incorporate that content into other works without authorization from Vascend or the relevant rights holder, except to the extent permitted by applicable law. Nothing in this clause restricts conduct that Australian law expressly permits.
8. Disclaimer
The Services are provided on an “as available” basis. To the extent permitted by law, we do not provide warranties regarding uninterrupted access, accuracy of information, or suitability for a particular purpose. Nothing in these Terms excludes rights you may have under applicable consumer protection laws, including the Australian Consumer Law.
9. Limitation of Liability
To the fullest extent permitted by law, Vascend is not liable for indirect or consequential loss, loss of data, or loss of profits or opportunity arising from your use of the Services. Where liability cannot be excluded, it is limited to the extent permitted by law.
10. Privacy
Your use of the Services is also governed by our Privacy Policy, set out in Part 2 of this document.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business structure, or legal obligations. Routine updates take effect once published on this page, with the “Last updated” date revised accordingly, and your continued use of the Services after a routine update is published constitutes acceptance of that update.
Where a change would materially affect existing contractual rights you have under these Terms, we will take reasonable steps to bring that change to your attention before it takes effect.

These Terms are governed by the laws of New South Wales, Australia.
